These Terms govern your use of Mobidata (the "Service"), operated by Mobidata ("we", "us"). By creating an account, publishing a listing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Mobidata
You must be at least 18 years old and legally able to form a binding contract in your jurisdiction. If you use Mobidata on behalf of an organization (a phone shop, repair store, or chain), you represent that you are authorized to bind that organization, and "you" means both you and that organization.
2. Accounts
- You are responsible for keeping your password, OTP codes, and session tokens confidential.
- You must provide accurate, current information during signup and keep it up to date.
- You must tell us immediately if you suspect your account has been accessed without your permission.
- We may suspend or terminate accounts that violate these Terms, that are used for fraud, or that are subject to a valid legal order.
3. Merchant obligations (seller intake)
Merchants use Mobidata to record every preowned device they buy from a seller. Each intake captures seller identity, device condition, IMEI, and a short consent video in which the seller confirms the voluntary sale. You agree that:
- You will collect informed, voluntary consent from every seller before recording them on video or photographing their identification.
- You will not alter, fabricate, or forge intake records, photos, or consent videos. Media is cryptographically hashed at capture; tampering is detectable.
- You will comply with all local laws governing second-hand-goods dealers, AML / KYC requirements, and data retention periods applicable in your jurisdiction.
- You will not use Mobidata to register devices you reasonably believe are stolen. Any duplicate IMEI across organizations within the last 24 months is flagged for our review; you agree to cooperate with that review.
- You remain the controller of seller personal data you collect. Mobidata acts as your data processor for that data. See our Privacy Policy for the split of responsibilities.
4. Marketplace listings (optional)
Publishing a device to the public marketplace is an optional, separate action from intake. When you publish, you agree:
- The listing photos you select must be of the same physical device recorded in the intake.
- You will not publish seller identity, selfies, national ID photos, nominee card photos, or consent video to the marketplace. Mobidata never serves those from the public bucket.
- You will set an accurate price, condition grade, and description. Knowingly misleading listings may be withdrawn by us without notice.
- You are the seller of record for each marketplace transaction. Mobidata does not handle payment, delivery, or dispute resolution at the MVP stage.
5. Buyer obligations
- Browsing and saving listings does not create a sale contract with Mobidata.
- If you contact a merchant through Mobidata, your contact request and message are logged for abuse prevention.
- You may report suspected stolen devices, counterfeit listings, or misleading pricing via the "Report" button on any listing.
6. Prohibited use
You may not use the Service to:
- Upload content that is illegal, infringing, hateful, pornographic, or targets minors.
- Collect seller or buyer personal data for purposes other than completing the intake / sale you recorded it for.
- Probe, scan, or attempt to bypass authentication, rate limits, integrity checks, or the 4-eyes deletion approval flow.
- Impersonate another merchant, chain, or government authority.
- Reverse-engineer, scrape, or resell access to the Service.
7. Data integrity and retention
Intake media (10 photos + 1 consent video per device) is the evidentiary backbone of Mobidata. We protect it through an 11-layer durability stack described in our durability documentation, including:
- Client-side SHA-256 computed at capture and re-verified server-side.
- Cloudflare R2 primary storage with versioning and Object Lock on consent videos.
- Nightly cross-region DR sync and monthly immutable archives.
- RFC3161 trusted timestamps on consent videos.
- 4-eyes approval on any hard delete.
Soft-deleted data is retained for 30 days before hard purge. Seller documents are retained 24 months after a device is marked sold, unless local law requires a different period. You may request export or deletion of your own user data at any time via Settings → Danger Zone.
8. Fees
The MVP is free to use. If we introduce paid plans or transaction fees, we will give you at least 30 days' notice and the opportunity to export your data before changes take effect.
9. Intellectual property
- You retain ownership of content you upload (photos, videos, descriptions). You grant us a worldwide, royalty-free license to host, transcode, back up, and display that content only as needed to operate the Service.
- Mobidata, the logo, design tokens, and code are our property. These Terms do not grant you any right to use them except as needed to use the Service.
10. Disclaimer of warranties
The Service is provided as-is, without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure against every possible threat. We do not verify the legal title of devices registered on the platform; merchants and buyers are responsible for their own due diligence.
11. Limitation of liability
To the maximum extent permitted by applicable law, Mobidata is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, loss of data, or goodwill, arising out of your use of the Service. Our aggregate liability under these Terms will not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD 100.
12. Indemnity
You agree to defend and indemnify us against any claim arising from your breach of these Terms, your content, or your use of the Service in violation of law.
13. Governing law and disputes
These Terms are governed by the laws of the People's Republic of Bangladesh (without regard to conflict-of-laws rules). Disputes will be resolved exclusively in the courts of Dhaka, except that either party may seek injunctive relief in any competent court to protect its intellectual-property rights.
14. Changes to these Terms
We may update these Terms. Material changes will be announced in-app and via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
